Terms of Service

These terms apply when you subscribe to a website from Dybng. We have tried to keep them short and easy to read.

2. The service

We provide your website as a subscription. It includes:

• design of your website
• hosting
• your own domain
• software and security updates
• support

3. Plans, prices and billing

There is no minimum term. For each plan you choose how you pay: monthly, 6 months prepaid, or 12 months prepaid. Prepaying gives you a lower monthly price.

• Starter: USD 59 / CAD 79 per month billed monthly; USD 54 / CAD 74 per month with 6 months prepaid (USD 324 / CAD 444 every 6 months); USD 49 / CAD 69 per month with 12 months prepaid (USD 588 / CAD 828 every 12 months)
• Growth: USD 119 / CAD 169 per month billed monthly; USD 109 / CAD 154 per month with 6 months prepaid (USD 654 / CAD 924 every 6 months); USD 99 / CAD 139 per month with 12 months prepaid (USD 1,188 / CAD 1,668 every 12 months)
• Pro: USD 239 / CAD 339 per month billed monthly; USD 219 / CAD 309 per month with 6 months prepaid (USD 1,314 / CAD 1,854 every 6 months); USD 199 / CAD 279 per month with 12 months prepaid (USD 2,388 / CAD 3,348 every 12 months)

You pay by card through Stripe. Your card is charged automatically at the start of each billing period: every month, or every 6 or 12 months if you prepay. There is no setup fee.

A prepaid period of 6 or 12 months renews automatically for the same length and at the same price, unless you cancel or switch before the renewal date. The price only changes at renewal if we have told you about the new price at least 30 days before the renewal date.

Changing plans: an upgrade applies right away, and you pay the difference for the rest of your current period. If you pay monthly, that is the rest of the month; if you have prepaid, it is the rest of the prepaid period. The difference is calculated pro rata per day for the days left in the period. A downgrade, or a switch to monthly billing, takes effect from the next period.

4. Cancellation and refunds

You can cancel at any time in the customer portal or by emailing [email protected]. There is no cancellation fee.

• Monthly billing: your cancellation takes effect at the end of the month you have paid for.
• 6 or 12 months prepaid: if you cancel before the renewal date, the period does not renew. Your website stays online until the end of the period you have paid for.

14-day money-back guarantee: whichever billing option you choose, you can get your first payment back if you ask within 14 days of paying it. The guarantee applies only to your very first payment, not to payments after you change billing period or plan. After that, payments are not refunded, also not for the rest of a prepaid period, but your website stays online until the end of the period you have paid for.

5. Ownership and buyout

You can buy out your website at any time for a fixed price of USD 1,590 / CAD 2,250 / NOK 14,990. With a buyout you get the website files and source code, all text and images, and up to 1 hour of help moving the site. After a buyout, you can add hosting and support as a separate plan if you want us to keep running the site.

If you cancel without a buyout:

• Your domain is always yours. We help you move the DNS settings, free of charge.
• Within 7 days after your subscription ends, we send you your text, images and logo as a zip file.
• Your website is taken offline, and the files are deleted 30 days later. We confirm by email when they have been deleted.
• The code and the template belong to Dybng.

6. Your responsibilities

You are responsible for the content you give us. It must be accurate, you must have the rights to the photos and text you provide, and it must not be unlawful.

7. Changes to prices or terms

If we change our prices or these terms, we will tell you by email at least 30 days before the change takes effect. For a prepaid period, a new price applies only from a renewal that is at least 30 days after we told you; until then, the period renews at the same price.

8. Availability

We work to keep your website online at all times, but uptime is provided on a best-effort basis and we cannot guarantee that it will never be interrupted.

9. Liability

Our total liability to you under these terms is limited to 3 times the monthly price of your plan.

This limit does not apply if we caused the loss intentionally or through gross negligence.

10. Governing law and disputes

These terms are governed by Norwegian law. Stavanger District Court (Stavanger tingrett) is the agreed venue for any dispute.

11. Privacy

Our privacy policy explains how we handle personal information.

12. Existing agreements

If you signed an agreement with us before these terms were published, your original agreement and its terms continue to apply.
